Quick answer

New Mexico payroll tax registration at a glance

New Mexico employers usually open two accounts. The Taxation and Revenue Department (TRD) issues a New Mexico Business Tax Identification Number (NMBTIN) at no cost, and you use it for wage withholding and the quarterly workers' compensation fee. The Department of Workforce Solutions (NMDWS) handles unemployment insurance and issues an Employer Account Number (EAN).

In 2026, unemployment tax applies to the first $34,800 of each employee's wages. New employers pay the greater of their industry's average rate or 1%. Since January 1, 2026, every employer must file and pay withholding electronically, and new hires are reported within 20 days.

Registration steps

How to register in New Mexico

Two online registrations, then new hire reporting.

  1. Get your federal EIN from the IRS before you register.
  2. Apply for a Business Tax ID with TRD in the Taxpayer Access Point (TAP) by choosing "Apply for a New Mexico Business Tax ID," or file Form ACD-31015. There is no fee.
  3. Check your registration certificate. It shows your withholding filing frequency: monthly, quarterly or semiannual.
  4. Register with NMDWS in the Unemployment Insurance Tax and Claims System, then activate the account so it can accept wage reports and payments.
  5. Ask employees for a W-4. New Mexico has no state form; employees may give you a copy of the federal W-4 marked "For New Mexico State Withholding Only."
  6. Report each new hire and rehire within 20 days on the New Mexico New Hire website.

  • Your first hire date and the wages you paid each quarter, which set your NMDWS liability
  • A W-4 copy for New Mexico from employees who want different state withholding (optional)

Pitfalls

New Mexico mistakes to avoid

Most problems come from the 2026 filing changes.

  • Filing on paper. Since January 1, 2026, all employers must e-file and e-pay withholding and the workers' compensation fee.
  • Using retired forms. TRD-41431 replaced the WC-1 and TRD-31109 for periods starting January 1, 2026.
  • Using the old due date. Quarterly withholding and workers' compensation fee returns are now due the 25th, not the last day of the month.
  • Skipping zero UI reports. NMDWS requires a quarterly wage report even when no wages were paid, unless your account was terminated or suspended.
  • Forgetting to activate the NMDWS account. NMDWS can't accept wage records until you do.

Related duties

Other New Mexico employer obligations

These run alongside the tax accounts.

  • New hire reporting. Report new and rehired employees within 20 days, whether full-time, part-time or temporary. The Health Care Authority's Child Support Services points employers to the New Mexico New Hire website.
  • Workers' compensation insurance. The Workers' Compensation Administration lists three groups that need it: businesses with three or more employees, construction contractors, and businesses registered as an LLC or incorporated (some exceptions apply to this group; the WCA Employer Compliance Bureau confirms them). This is separate from the quarterly workers' compensation fee paid to TRD.
  • Annual withholding statements. File W-2s and other withholding statements with TRD electronically by January 31.
